Information Regarding Virtual Public Meetings and Hearings: 

In accordance with 29 Del. C. Section 10001 et.al., all Public Hearings will be held as virtual meetings utilizing Zoom Webinar.  The Multipurpose Room of the James H. Gilliam, Jr. Building located at 67 Reads Way will be accessible during scheduled hearing times for members of the public to attend virtual meetings in-person. The appropriate weblink, call-in number(s) and webinar ID number for all hearings may be found approximately two (2) business days prior to the scheduled hearing date at the top of the appropriate meeting *agenda.

Note for Applicants only: 
Applicants must submit presentation materials electronically to the Department of Land Use no less than five (5) business days prior to the scheduled public hearing. Please email us with any questions.

PLEASE NOTE: The Board of Adjustment Application has recently been revised to include additional checkboxes for non-residential applications pertaining to communication with the Community and District Councilperson, and a checkbox for color renderings of building(s) elevations of any structure proposed are attached.

Regular Meetings (Public Hearings)

  • 6 p.m.
  • Second and Fourth Thursday of the month (Note: Business Meetings are typically held immediately following the Public Hearings.) Dates, times and/or locations of meetings and hearings are subject to change.
  • All meetings are *open to the public  
    *In accordance with Governor Carney’s Declaration of a State of Emergency, the Department of Land Use is now holding all public hearings and meetings in a "virtual" format as a telephone and video conference, utilizing Zoom Meetings. Members of the public wishing to join any Land Use Board public hearing or other public meeting may do so by utilizing a link or phone number(s) and the appropriate Zoom meeting ID. This information will be specified on the appropriate Public Hearing/Meeting Agenda no less than two (2) business days prior to the scheduled hearing date.

About the Board

Members are appointed by the County Executive and County Council. The Board hears requests from property owners for variances from a variety of county laws and regulations.

Legal authority for the composition and responsibilities of the Board of Adjustment may be found in DE Title 9, subsections 1311 through 1314 and in the New Castle County Code 40.30.320.
